AT&T this morning dropped word that its version of the Samsung Galaxy Tab 2 can now update to Android 4.1.2 Jelly Bean. 

That's the good news. The bad news is that you have to do it with Samsung KIES on a Mac or PC. A tethered update is better than no update at all, of course.

U.S. seeks Snowden's extradition, urges Hong Kong to act quickly

WASHINGTON (Reuters) - The United States said on Saturday it wants Hong Kong to extradite Edward Snowden and urged it to act quickly, paving the way for what could be a lengthy legal battle to prosecute the former National Security Agency contractor on espionage charges.

Legal sources say Snowden, who is believed to be hiding in Hong Kong, has sought legal representation from human rights lawyers since leaking details about secret U.S. surveillance activities to news media.

"If Hong Kong doesn't act soon, it will complicate our bilateral relations and raise questions about Hong Kong's commitment to the rule of law," a senior Obama administration official told Reuters, speaking on condition of anonymity.

U.S. National Security Adviser Tom Donilon told CBS News the United States had a "good case" to bring Snowden back to America to face trial and expected Hong Kong to comply with its extradition treaty.

"We have gone to the Hong Kong authorities seeking extradition of Snowden back to the United States," Donilon said.

He added that U.S. law enforcement officials were in a "conversation" with Hong Kong authorities about the issue.

A senior U.S. law enforcement source said extradition "can, of course, be a lengthy legal process" but expressed optimism that Snowden would be sent back to the United States.

The South China Morning Post reported that Snowden was not detained or in police protection - as reported elsewhere - and instead he was in a "safe place" somewhere in Hong Kong.

The paper also quoted Snowden offering new details about America's spy activities, including accusations of U.S. hacking of Chinese mobile phone companies and targeting China's top Tsinghua University.

"The NSA does all kinds of things like hack Chinese cellphone companies to steal all of your SMS (texting) data," Snowden was quoted by the newspaper as saying in a June 12 interview.

Documents previously leaked by Snowden revealed that the NSA has access to vast amounts of internet data such as emails, chat rooms and video from large companies, including Facebook and Google, under a government program known as Prism.

They also showed that the government had worked through the secret Foreign Intelligence Surveillance Court to gather so-called metadata - such as the time, duration and telephone numbers called - on all calls carried by service providers such as Verizon.

On Friday, the Guardian newspaper, citing documents shared by Snowden, said Britain's spy agency GCHQ had tapped fiber-optic cables that carry international phone and internet traffic and is sharing vast quantities of personal information with the NSA.

ESPIONAGE CHARGES

The United States charged Snowden with theft of government property, unauthorized communication of national defense information and willful communication of classified communications intelligence to an unauthorized person, according to the June 14 criminal complaint made public on Friday.

The latter two offenses fall under the U.S. Espionage Act and carry penalties of up to 10 years in prison.

Scores of Americans have been sent back home from Hong Kong to face trial under the extradition treaty. But the process can take years, lawyers say, and Snowden's case could be particularly complex.

America's use of the Espionage Act against Snowden has fueled debate among legal experts about whether that could complicate his extradition, since the treaty includes an exception for political offenses and Hong Kong courts may choose to shield him from prosecution.

Snowden says he leaked the details of the classified U.S. surveillance to expose abusive and illegal programs that trampled on citizens' privacy rights.

President Barack Obama and his intelligence chiefs have vigorously defended the programs, saying they are regulated by law and that Congress was notified. They say the programs have been used to thwart militant plots and do not target Americans' personal lives.

Stephen Vladeck, a professor at American University's Washington College of Law who studies national security issues, said there is no clear definition of what constitutes a political offense under the treaty.

"My intuition says it'll be easier for Snowden to argue espionage is a political offense than (the U.S. charge of) theft of government property," Vladeck said.

Should he return to the United States, Snowden would face trial in a federal court in Virginia that has a long track record of hearing cases related to national security and also to cyber crime.

In the past 20 years, the U.S. government has racked up remarkable success rates in winning convictions or guilty pleas from people brought before the federal court in Virginia who were accused of espionage or terrorism. Because of its speed, the court is considered a "rocket docket.

Funeral plans set for actor James Gandolfini

NEW YORK (AP) ? Funeral services for actor James Gandolfini will be Thursday at the Cathedral Church of Saint John the Divine in New York City.

An HBO spokeswoman speaking on behalf of the family says the funeral is scheduled for 10 a.m.

The 51-year-old star of "The Sopranos" died Wednesday in Rome. Family spokesman Michael Kobold says Gandolfini died of a heart attack.

The Italian news agency ANSA reports Gandolfini's body departed Rome for the United States on Sunday. Kobold earlier told reporters the "provisional plan" was to repatriate Gandolfini's body Monday.

The actor had been headed to Sicily to appear at the Taormina Film Festival, which paid tribute to him Saturday.

La Jolla Festival of the Arts Kicks Off at UCSD [Photos] - Entertainment

The La Jolla Festival of the Arts is Saturday and Sunday from 10 a.m. to 5 p.m.

The sun was shining Saturday for the first day of the La Jolla Festival of the Arts at UC San Diego's Warren Field.

The two-day event is produced by Torrey Pines Kiwanis, a non-profit organization that raises funds to support adaptive sports and recreation programs for San Diegans with disabilities.

La Jolla Festival Arts will be from 10 a.m. to 5 p.m. on Saturday, June 22 and Sunday, June 23 at UC San Diego Warren Field.

The genome's 3-D structure shapes how genes are expressed

June 23, 2013 ? Scientists from Australia and the United States bring new insights to our understanding of the three-dimensional structure of the genome, one of the biggest challenges currently facing the fields of genomics and genetics. Their findings are published in Nature Genetics, online today.

Roughly 3 metres of DNA is tightly folded into the nucleus of every cell in our body. This folding allows some genes to be 'expressed', or activated, while excluding others.

Dr Tim Mercer and Professor John Mattick from Sydney's Garvan Institute of Medical Research and Professor John Stamatoyannopoulos from Seattle's University of Washington analysed the genome's 3D structure, at high resolution.

Genes are made up of 'exons' and 'introns' - the former being the sequences that code for protein and are expressed, and the latter being stretches of noncoding DNA in-between. As the genes are copied, or 'transcribed', from DNA into RNA, the intron sequences are cut or 'spliced' out and the remaining exons are strung together to form a sequence that encodes a protein. Depending on which exons are strung together, the same gene can generate different proteins.

Using vast amounts of data from the ENCODE project*, Dr Tim Mercer and colleagues have inferred the folding of the genome, finding that even within a gene, selected exons are easily exposed.

"Imagine a long and immensely convoluted grape vine, its twisted branches presenting some grapes to be plucked easily, while concealing others beyond reach," said Dr Mercer. "At the same time, imagine a lazy fruit picker only picking the grapes within easy reach.

"The same principle applies in the genome. Specific genes and even specific exons, are placed within easy reach by folding."

"Over the last few years, we've been starting to appreciate just how the folding of the genome helps determine how it's expressed and regulated,"

"This study provides the first indication that the three-dimensional structure of the genome can influence the splicing of genes."

"We can infer that the genome is folded in such a way that the promoter region -- the sequence that initiates transcription of a gene -- is located alongside exons, and they are all presented to transcription machinery."

"This supports a new way of looking at things, one that the genome is folded around transcription machinery, rather than the other way around. Those genes that come in contact with the transcription machinery get transcribed, while those parts which loop away are ignored."

NCCR Launches New RFS Campaign - Restaurant News - QSR ...

The National Council of Chain Restaurants (NCCR) launched ?Feed Food Fairness: Take RFS Off the Menu,? a new grassroots campaign focused on repealing the federal Renewable Fuel Standard (RFS) and the corn ethanol mandate. Coalition members joined with Virginia representative Bob Goodlatte, to expose the harmful economic effects of the RFS on American consumers, diners, and small business-owners and operators.

?

?The National Council of Chain Restaurants is committed to repealing the corn ethanol mandate and the Renewable Fuel Standard,? says Rob Green, NCCR executive director. ?Today we are mobilizing the restaurant community to join this coalition - composed of small businesses owners, operators, franchisees, and the entire food supply chain - to urge Congress to repeal the flawed RFS. The law unfairly increases food and commodity costs for chain restaurants and ultimately American diners and shoppers across the country. It is time for small business to engage directly in this important debate and ask their lawmakers to take RFS off the menu.?

Coalition members and partners in attendance at the Capitol Hill news conference included chain restaurant companies, small business owners, operators and franchisees, and supply chain partners who each described how the RFS hurts their business, stifles economic growth, and adversely impacts consumers and diners.

?White Castle is a fourth generation family business,? says Lisa Ingram, president of White Castle. ?We have seen firsthand how increasing food prices caused by the Renewable Fuel Standard affect not only our business, but American families who patronize our restaurants. In total, the RFS and corn ethanol mandate costs chain restaurants up to $3.2 billion annually.?

?I began my career in Jackson, Michigan, training to be a manager for a local franchise,? says Mark Behm, a Wendy?s franchise owner in Michigan. ?Now nearly 40 years later, my partners and I own the franchise. We are in pursuit of the American dream. But operating a small business in the U.S. is hard, especially in Michigan and during these economic times. The federal ethanol mandate unfairly increases the cost of food across the board."

?The Renewable Fuel Standard has directly affected the supply and cost of feed in major agricultural sectors of this country, affecting the family ranch and farm,? adds Steve Foglesong, a cattle producer and former president of the National Cattlemen?s Beef Association. ?Even in the wake of the worst drought in decades, the Environmental Protection Agency refused to grant relief through a waiver, making it apparent that the RFS is broken, and Congress needs to act. Cattlemen and women are not opposed to renewable fuels, but are seeking a level playing field to compete for a bushel of corn.?

?Feed Food Fairness? will mobilize a broad base of small business owners and operators and coalition members to urge Congress to pass the Renewable Fuel Standard Elimination Act (H.R. 1461), introduced by representative Goodlatte, which would repeal the federal RFS mandate.

Leaders of Exodus International, which announced it is closing this week, are starting a new group aimed at finding common ground within conservative churches and fostering acceptance of all sexual orientations.?

Exodus International, a longtime leader in the Christian "gay conversion therapy" movement, is closing its doors, having concluded that trying to counsel people out of same-sex attractions doesn?t work and can do grave harm. The group?s president, Alan Chambers, issued a lengthy apology this week at the organization?s final conference.

But the debate within the conservative Christian world over homosexuality is far from over, and it may well get sharper as the politics of gay rights ? especially gay marriage ? intensifies.?

Most of Exodus?s affiliates had already left before Mr. Chambers?s announcement and are expected to keep doing conversion therapy. A new umbrella group is already in place, the Restored Hope Network, which its website says is ?dedicated to restoring hope to those broken by sexual and relational sin, especially those impacted by homosexuality.? On Friday and Saturday, the group is having its first annual conference in Oklahoma City.

But some of Exodus?s leaders aren?t going away. They?re planning a new endeavor that they say accepts people as they are ? a reflection of changing views, particularly among younger Evangelicals, toward homosexuality and gay rights.

In interviews with the Monitor, two of Exodus?s leaders spoke of their own experiences with same-sex attraction, their abiding religious faith, and how they hope to find common ground in addressing social problems.

?Exodus has been a lightning rod ministry, and it?s been really one side of a debate, a raging debate, on issues related to sexuality,? says Chambers, speaking on the phone from his conference in Irvine, Calif.

?Our desire in the church is to be people of peace and to be known by our ability to be in relationship with and have conversations with all different types of people. And so we want to create opportunities and conferences and spaces where people can come together who have different opinions, and different worldviews, to talk about really complex issues.?

By ?church,? he says, he means the ?global? Christian church, not any particular denomination. His new, as-yet-unnamed, endeavor ?will be rooted in a desire to ?reduce fear,? he says. The website, still under construction, is ReduceFear.org.

Chambers hopes that people of faith, regardless of sexual orientation, can come together for the common good to combat social ills such as bullying. ?

"We?ve got to get to a different place in our culture than we are at today, certainly within the church,? he says. ?There are gay and lesbian people who are in the church, and there are people who have very different beliefs about that who are in the church.?

But he tries to steer clear of politics and has no position on same-sex marriage, saying it?s a ?distraction to the people we minister to.? ?

BMW Car-to-X communicationThe success of a recent mobility project could pave the way for new in-car and motorcycle safety technology that could help drivers avoid potential accidents a block away. ?

The technology, called Car-to-X communication, enables vehicles to directly communicate with one another as well as traffic infrastructure such as traffic light signals using a wireless LAN or mobile network connections.

The project, known as simTD (Safe and Intelligent Mobility ? Test Field Germany), involved four years of research by Car-to-X as part of a joint venture with companies from the automotive, motorcycle, ?telecoms and research sectors.

BMW engineers developed two driver assistance systems based on Car-to-X communication for the project ? the Cross Traffic Assistant and the Traffic Sign Assistant, according to an official press release.

The Cross Traffic Assistant relies on shared data among vehicles on the basis of received data concerning road users in the area, warning drivers and riders of potential hazards such as stopped congested traffic, vehicles entering intersections, roadway obstructions (especially pertinent for motorcyclists), red lights and more. ?The system evaluates all incoming data, such as the speed, distance from the intersection and direction of travel of other road users, along with information generated by the driver?s own vehicle. If the driver does not react to an intersecting vehicle, he will be warned by visual as well as acoustic signals,? explains Dr Christoph Grote, Head of BMW Group Research and Technology, in a press release statement.

The Traffic Sign Assistant shares data relating to road and traffic situations, such as current speed limits or congestion warnings.

More than 120 test vehicles were used in the project in driving conditions in and around Frankfurt am Main including an analysis of roughly 4,000 crossings of intersections.

?The investigations proved that, with the current close-to-production positioning technology, the Cross Traffic Assistant function already has the potential to prevent many accidents at intersections,? says Grote.

The BMW Group was the only project partner to involve both cars and motorcycles in the field trial.

Other simTD project partners included Adam Opel AG, AUDI AG, Daimler AG, Ford Research Centre Aachen, Volkswagen AG to name a few.

What's New: The 2014 Nissan Versa Note is the all-new second-generation version of the outgoing Versa hatchback. The 109-horsepower 1.6-liter four-cylinder engine is more in line with the Versa sedan than the 122-horsepower 1.8-liter in the 2012 Versa hatchback. Driving Character: The 2014 Nissan Versa Note handles itself well on the road. Power is down from the outgoing 2012 Versa hatchback, but the curb weight is down even more?to the tune of some 300 pounds. The result isn't exactly a corner carver, but good steering feel and an almost too responsive accelerator help to make up for a passable but occasionally lost CVT transmission and a ride that feels slightly harder than necessary. Overall, the Versa Note is a good-looking car that isn't as slow as its figures would suggest; there's a good bit of fun to be had behind its wheel.

Favorite Detail: With quick turn-in response and great all-around feel, the 2014 Versa Note's steering is an unexpected treat. With Nissan hoping to appeal to a wider consumer base, the driving input isn't tuned as sportily as, say, the Honda Fit's, but it still makes the Note feel a tick more nimble than it actually is. The Versa Note's steering is a nice little touch that, were it not there, would make the Note just another tiny five-door hatchback in an increasingly crowded subcompact market.

Driver's Grievance: Our main issue with the 2014 Nissan Versa Note is an oldie but goodie: the five-speed manual transmission is only available on the base model, while the others come with the CVT only. This is done in the name of fuel efficiency, and Nissan expects manuals to make up around only 10 percent of sales. We like the Versa Note; we would be persuaded to buy if the manual were available in higher trim levels.

Bottom Line: A cut of around 300 pounds and aerodynamic design elements all over help contribute to the 2014 Nissan Versa Note's impressive mileage figures. More impressive is how Nissan managed to integrate the aero-focused design into a car that looks as good as the Versa Note. For a subcompact, the 2014 Versa Note doesn't feel like it's lacking for power?in fact we came away from our test wondering if the throttle response was overly quick. Nissan has pulled off a fun trick with the new Versa Note: It produced a car that by rights should be a slow, plodding, uninspiring econobox, but instead is cute, reasonably comfortable, and fun to drive when you feel like having fun. Now if only we could talk Nissan into giving us the option of a five-speed manual in more than just the base model, and all would be right with this excellent new subcompact hatchback.

?Undefeated' screening

The Wilmington Police Department will hold a free public screening at 6 p.m. Thursday of the movie "Undefeated," which chronicles the rise of a high school football program after years of losses. The film won the 2012 Academy Award for best documentary.

The screening is at the CFCC Schwartz Center, 601 N. Front St. in Wilmington. Admission is free, but tickets are required. They can be picked up at the Wilmington Police Department (615 Bess. St.), WWAY TV (615 N. Front St.) or the CFCC Business Office (402 N. Front St.). For group seating, contact the Police Community Resource Coordinator's Office at 341-4608.

Sharks win late Tuesday

The Wilmington Sharks picked up a 2-1 victory over Martinsville on Tuesday night in a game that lasted more than four hours due to a 75-minute rain delay.

Martinsville (6-12) led 1-0 before the weather stopped things in the top of the sixth. Wilmington (9-8), however, rallied behind a pair of Tennessee Tech teammates. The Sharks tied the game in the eighth on a Zach Stephens RBI single, and Dylan Bosheers' flare single in the ninth drove in the game-winning run.

The Sharks are back at Buck Hardee Field at 7 p.m. Thursday against Columbia.

(AP) ? Cars and trucks are rolling again across the Interstate 5 Skagit River bridge, restoring the traffic flow on the main route between Seattle and Vancouver, British Columbia.

A temporary span opened Wednesday morning, replacing a section of the bridge that collapsed May 23 when it was struck by a truck with an oversize load.

Workers with the state Department of Transportation and contractors rushed work on the temporary span to relieve drivers who lined up to detour through Mount Vernon and Burlington. The bridge carries 71,000 vehicles a day.

Those vehicles are back on the freeway, but they'll be slowed at the bridge where the speed is reduced to 40 mph because of narrow lanes on the 160-foot temporary section. It carries two 11-foot lanes in each direction. Oversized and overweight loads will still be detoured.

The temporary bridge pieces were supplied by Acrow Bridge through an emergency contract the Transportation Department signed with Atkinson Construction. The Max Kuney construction company of Spokane was selected Tuesday for a permanent replacement this fall.

The temporary span and replacement cost nearly $18 million. The federal Transportation Department is paying for all but about $1 million of the work.

Despite all the work, the 58-year-old bridge is still rated as "functionally obsolete" because it was not designed to handle today's traffic volume and big trucks. It's also "fracture critical," meaning that if a single, vital component is compromised, the bridge can crumple again.

In the accident last month, the driver of the oversized truck felt crowded by another southbound semi-truck on the bridge and the load struck a girder, causing one section of the bridge to fall, a preliminary National Transportation Safety Board report said. A final NTSB report on the cause of the bridge failure is likely months away.

A car and pickup truck went into the water and three people were rescued. Washington State Patrol Trooper Sean O'Connell was killed May 31 when his motorcycle collided with a truck while he was directing detoured traffic in Conway.

Apple has been caught up in multiple lawsuits for years. The most well known patent dispute involving the Cupertino tech giant is the ongoing court battle against rival manufacturer, Samsung. However, today, another company has decided to take on the iPhone maker in court.

Bluebonnet Telecommunications, a Texas based telecommunications company, has filed a suit against Apple for patent infringement for the new call forwarding feature present on the iPhone 5.?The disputed patent (U.S. patent 5,485,511)?covers??method and apparatus for determining the telephony features assigned to a telephone.? The company claims that Apple has been infringing upon this patent for years. ?Apple ? offered for sale products and/or systems (including at least the iPhone 4S and iPhone 5) that infringed one or more claims of the 511 patent.?

In addition to claiming that the iPhone 4S and 5 violate the patent, Bluebonnet also claims that Apple has encouraged its users to violate the patent because the company encourages the use of features that violate the patent. The suit claims that Apple?s call forwarding system violates this patent, but does not go into many specifics regarding how the features go against the patent.

(AP) ? The Internal Revenue Service is about to pay $70 million in employee bonuses despite an Obama administration directive to cancel discretionary bonuses because of automatic spending cuts enacted this year, according to a GOP senator.

Sen. Chuck Grassley of Iowa says his office has learned that the IRS is executing an agreement with the employees' union on Wednesday to pay the bonuses. Grassley says the bonuses should be canceled under an April directive from the White House budget office.

The directive was written by Danny Werfel, a former budget official who has since been appointed acting IRS commissioner.

"The IRS always claims to be short on resources," Grassley said. "But it appears to have $70 million for union bonuses. And it appears to be making an extra effort to give the bonuses despite opportunities to renegotiate with the union and federal instruction to cease discretionary bonuses during sequestration."

The IRS said it is negotiating with the union over the matter but did not dispute Grassley's claim that the bonuses are imminent.

Office of Management and Budget "guidance directs that agencies should not pay discretionary monetary awards at this time, unless legally required," IRS spokeswoman Michelle Eldridge said in a statement. "IRS is under a legal obligation to comply with its collective bargaining agreement, which specifies the terms by which awards are paid to bargaining-unit employees."

Eldridge, however, would not say whether the IRS believes it is contractually obligated to pay the bonuses.

"In accordance with OMB guidance, the IRS is actively engaged with NTEU on these matters in recognition of our current budgetary constraints," Eldridge said.

The National Treasury Employees Union did not respond to requests for comment.

The IRS has been under fire since last month, when IRS officials acknowledged that agents had improperly targeted conservative groups for additional scrutiny when they applied for tax-exempt status during the 2010 and 2012 elections. A few weeks later, the agency's inspector general issued a report documenting lavish employee conferences during the same time period.

Three congressional committees and the Justice Department are investigating the targeting of conservative groups. And key Republicans in Congress are promising more scrutiny of the agency's budget, especially as it ramps up to play a major role in implementing the new health care law.

Much of the agency's top leadership has been replaced since the scandals broke. President Barack Obama forced the acting commissioner to resign and replaced him with Werfel, who used to work in the White House budget office.

In a letter to Werfel on Tuesday, Grassley said the IRS notified the employee union March 25 that it intended to reclaim about $75 million that had been set aside for discretionary employee bonuses. However, Grassley said, his office has learned that the IRS never followed up on the notice. Instead, Grassley said, the IRS negotiated a new agreement with the bargaining unit to pay about $70 million in employee bonuses.

Grassley's office said the information came from a "person with knowledge of IRS budgetary procedures."

"While the IRS may claim that these bonuses are legally required under the original bargaining unit agreement, that claim would allegedly be inaccurate," Grassley wrote. "In fact, the original agreement allows for the re-appropriation of such award funding in the event of budgetary shortfall."

Werfel wrote the directive on discretionary employee bonuses while he was still working in the White House budget office. The directive was part of the Obama administration's efforts to impose across-the-board spending cuts enacted by Congress.

The spending cuts, known as "sequestration," are resulting in at least five unpaid furlough days this year for the IRS' 90,000 employees. On these days, the agency is closed and taxpayers cannot access many of the agency's assistance programs.

Werfel's April 4 memorandum "directs that discretionary monetary awards should not be issued while sequestration is in place, unless issuance of such awards is legally required. Discretionary monetary awards include annual performance awards, group awards, and special act cash awards, which comprise a sizeable majority of awards and incentives provided by the federal government to employees."

"Until further notice, agencies should not issue such monetary awards from sequestered accounts unless agency counsel determines the awards are legally required. Legal requirements include compliance with provisions in collective bargaining agreements governing awards."

Football: California quarterback Cade Apsay verbally commits to CU Buffs

Colorado football coach Mike MacIntyre's 2014 recruiting class received another verbal commitment on Tuesday, coming from California quarterback Cade Apsay, the Santa Clarita Valley Signal reports.

The 6-2, 176-pound QB chose Colorado over scholarship offers from Arizona, New Mexico, Northern Colorado and Eastern Washington. Apsay is rated as a 3-star recruit by Rivals.com and threw for 3,333 yards as a junior at Canyon High School, with 33 touchdowns and 14 interceptions. He also rushed for 341 yards and 15 touchdowns, leading the Cowboys to an 8-3-1 record.

Apsay was the Foothill League's Offensive Player of the Year in 2012 and was selected to the CalHiSports.com All-State Junior Third Team. He joins offensive lineman Isaac Miller, linebacker Grant Watanabe and defensive back Chance Waz in CU's 2014 recruiting class.

Canyon's offensive coordinator Alex Reinwald tweeted to congratulate the quarterback on his commitment to Colorado.
