Tenaya Capital Closes ?Oversubscribed? $372M Fund, Seeks A New Kayak

moneyTenaya Capital, the venture fund spun out of Lehman Brothers in 2009 with a history of backing companies like Kayak, Palo Alto Networks and Zappos, has just closed its latest fund totalling $372 million -- in its words, oversubscribed against an initial target of $300 million. Union political donation ballot measure questioned

SACRAMENTO -- Government reform groups lashed out Monday at a ballot initiative that claims its intent is to eliminate special interest money from Sacramento.

At a news conference, leaders from Common Cause California and League of Women Voters said that Proposition 32, dubbed "Stop Special Interest Money Now," is an age-old assault on union power dressed up as campaign finance reform.

"It's not at all what it seems," said Trudy Schafer, of the state League of Women Voters. "It promises political reform but it's really designed by its special interest backers to help themselves and harm their opponents."

The measure was written by a core group of Orange County Republicans who have failed in three statewide campaigns to restrict labor unions' ability to collect members' dues for political purposes. This time, they've attempted to broaden their appeal by seeking to ban corporate and union donations to candidates and campaigns -- in addition to forbidding unions from collecting dues for campaigns.

But opponents said Proposition 32 will not take money out of politics because so-called super PACs and independent expenditure groups will still be allowed to spend unlimited money -- and will likely become even more predominant in campaigns.

In addition, a whole class of major commercial enterprises that are not considered corporations but have similar resources would be exempt from the measure's restrictions, opponents said. The bill does

not apply to limited liability companies (LLCs) like Wall Street investment firms, hedge funds, real estate developers and others, and it specifically exempts insurance companies from the payroll deduction ban, opponents said.

"I'm all for campaign finance reform," said Derek Cressman, western regional director for Common Cause. "I've spent the last 15 years of my life working for campaign finance reform. I know campaign finance reform, and, friends, Prop. 32 is not campaign finance reform."

Bankrolling the measure are a number of investors, CEOs and other wealthy individuals such as Palo Alto's Thomas Siebel, the chairman of the First Virtual Group, who has contributed $500,000.

Still, labor groups view the ballot measure as a deadly threat and have far outpaced supporters in the money chase. Since the most recent finance reports on April 30, they've added $3.4 million to the $3.9 million cash they had on hand for a total of $7.3 million. The Yes side has $1.9 million.

Proponents said there are no exemptions written into the measure, but that it defines corporations as defined under federal and state laws.

"Individuals can give," said Jake Suski, spokesman for the Yes on Proposition 32 campaign. "Prop. 32 is designed to allow individuals to have a stronger voice. And it empowers union members by allowing them to have a direct say over whether their money goes to political causes.

"Opponents want to talk about what the initiative doesn't do because they'll say or do anything that protects the status quo."

Less empowered individuals like teachers need their unions to add a collective voice to the political dialogue, said Lisa Sussman, an Auburn second grade teacher who is politically active with the California Teachers Association.

"It is grossly unfair that corporate special interests want to silence my voice," she said. Proposition 32 "does nothing to fix Sacramento's problems. Its loopholes would only allow the wealthy pushing this attack to increase their influence."

Sally Ride, the first American woman to fly in space, died on Monday at her home in San Diego. She was 61.

The cause was pancreatic cancer, her company, Sally Ride Science, announced on its Web site.

Dr. Ride, a physicist who was accepted into the space program in 1978 after she answered a newspaper ad for astronauts, flew on the shuttle Challenger on June 18, 1983, and on a second mission in 1984. At 32, she was also the youngest American in space.

She later became the only person to sit on both panels investigating the catastrophic shuttle accidents that killed all astronauts on board ? the Challenger explosion in 1986 and the Columbia crash in 2003.

Dr. Ride was finishing studies at Stanford University ? she had degrees in physics and astrophysics (and also English) ? and looking for a job when she saw NASA?s advertisement. She looked at the qualifications and said, ?I?m one of those people,? she told The New York Times in 1982.

She applied, and made the cut.

?The women?s movement had already paved the way, I think, for my coming,? she said.

By the time she began studying laser physics at Stanford, women had already broken through into the physics department, once a boys? club. And when she applied to the space program, NASA had already made a commitment to admit women.

But there were still rough spots. Speaking to reporters before the first shuttle flight, Dr. Ride ? chosen in part because she was known for keeping her cool under stress ? politely endured a barrage of questions focused on her sex: Would spaceflight affect her reproductive organs? Did she plan to have children? Would she wear a bra or makeup in space? Did she cry on the job? How would she deal with menstruation in space?

The CBS News reporter Diane Sawyer asked her to demonstrate a newly installed privacy curtain around the shuttle?s toilet. On ?The Tonight Show,? Johnny Carson joked that the shuttle flight would be delayed because Dr. Ride had to find a purse to match her shoes.

At a NASA news conference, Dr. Ride said: ?It?s too bad this is such a big deal. It?s too bad our society isn?t further along.?

The Soviets had already sent two women into space. When one came aboard a space station, a male cosmonaut welcomed her by saying the kitchen and an apron were all ready for her.

In her early days at NASA, Dr. Ride trained in parachute jumping, water survival, weightlessness and the huge G-forces of a rocket launch. She learned to fly a jet plane. She also switched from physics to engineering and helped in the development of a robotic arm for the space shuttle. The Challenger commander, Robert L. Crippen, chose her for the 1983 mission in part because of her expertise with the device. She was part of a crew of five that spent about six days in space, during which she used the arm to deploy and retrieve a satellite.

At Cape Canaveral, many in the crowd of 250,000 that watched the launching wore T-shirts that said, ?Ride, Sally Ride? ? from the lyrics of the song ?Mustang Sally.?

The next day, Gloria Steinem, editor of Ms. magazine at the time, said, ?Millions of little girls are going to sit by their television sets and see they can be astronauts, heroes, explorers and scientists.?

When the shuttle landed, Dr. Ride told reporters, ?I?m sure it was the most fun that I?ll ever have in my life.?

Her next mission, in 1984, lasted about eight days. She was on the roster for another shuttle flight before the Challenger blew up on Jan. 28, 1986, 73 seconds after taking off from Cape Canaveral. But the program was immediately suspended, and she retired the next year.

As a member of the panel appointed by President Ronald Reagan to investigate the accident, Ms. Ride gained a reputation for asking tough questions. The panel learned from testimony and other evidence that there had been signs of trouble on earlier Challenger flights, but that they had been dismissed as not critical. Dr. Ride told a colleague it was difficult not to be angered by the findings.

Since there are so many experts out there telling you what you should do, I thought we should discuss 8 ?ways NOT to get found online.

1} Don?t have a website: some real estate agents are awesome at this already. I know it?s strange but in a world where 98% of consumers are staring their home search online, meaning the Internet, 40% of them do not have a website. If you don?t have a real estate website you likely can?t be found online ? by anyone.

2} Have a crappy real estate website: the 2nd way to not get found online is to have a crappy real estate website. By ?crappy? I mean static HTML. You know the kind of website that was designed to be an electronic billboard online. These kind of sites sometime look ?pretty? with flash animation but it doesn?t matter because no one ever really see?s them. ?Unless you direct ?consumers to it

3} Don?t Update Your Website. The 3rd way to not get found online is by far the most common I see in the real estate space. Most real estate agents that have websites never update them. By update I mean, add new content. Google or any search engine has no incentive or reason to index a website that is not updated regularly or not at all.

4} Have Crappy Content. The 4th way not to get found online is the 2nd most prevalent. If it?s one thing I know for a fact, it?s that all content is not created the same. Crappy content is classified {by me} as content that sucks. Content that no one is looking for nor cares about. ?Content that no one would ever look for like ?why choose an ABR, CRS, GRI, e-pro etc real estate agent?

5} Duplicate Content. This is content that is copied verbatim from one website and pasted on another. I see this all the time in the real estate space. A real estate agent takes content from Inman, REALTOR.com, Zillow, NY Times and others and posts it onto their own real estate website.

6} Talk Only About You. Are you a real estate agent that doesn?t want to get found online? Then talking about you and your designations and awards and knowledge and experience is a great way to do it. No one is looking for you because they don?t know you even exist.

7} Don?t Syndicate Content. Not syndicating or distributing your content to social media channels like facebook, Twitter, Google +, Linkedin, StumbleUpon, Flickr, Pintrerest and others is a great way not to get found online.

8} Broad Keyword Content. Choosing keywords that are too broad will result in not getting found online or getting found by the wrong audience. How beneficial is it to get found by someone that wants to buy a home in Alaska if you like in Phoenix?

Like it or not, more of your business will rely on being found online when a consumer wants to buy or sell real estate. I don?t even know you and I know that you go online when you have a need ? for anything, so does your ideal client. I have already told you this but to many consumers a real estate agent is a commodity, this is why 80% of them will choose the 1st agent they find, but you don?t have a chance to get their attention if they can?t find you.

INEC and Nigerian elite formation electoral politics

IS?HAQ Modibo Kawu summed up in the following the import of the imminent gubernatorial elections in Edo State in his Vanguard Thursday, July 12, 2012 column.

?How the election plays out will give a broad indication of the progress on the route of democracy consolidation as well as the preparation of the political opposition to provide an alternative platform to the PDP in 2015. The baseline is that the Nigerian nation?s ruling class project has become a danger to the survival of the country itself; unfortunately, not even the political opposition can escape culpability for a significant share of the problems dogging our country.

If the electoral process does not implicitly deepen confidence, that it can be used to remove bad government and reward those working in the interest of the people, even the legitimacy of the entire process will be lost. The alternative of violence killing and de-legitimization of Nigeria will spiral out of control. Edo?s election this weekend concerns all of us?.

All of the above judgments are unified by a theory of liberal democratic constitutionalist electrocracy. The theory is not derived from the interests of political parties engaged in vote collection for office holding. The first fact in support of the above assertion is Nigeria?s opposition-less electoral politics. From the era of Nigeria?s colonial parliamentary politics till date, there has always been one nationally dominant party serving as the convener of a government of national unity.

There has not been oppositional politics, where the opposition organises a national consensus on alternative legislative agenda of government business. Oppositional politics as thus defined is intra-governing elite politics and an expression of factional differences within the governing elite.

Elite factional electoral parties competing for majority control of government contest for support of electorates unified on interests that government should serve and are capable of holding government to account. A responsible electorate able to monitor government?s loyalty to its interest and to punish a disloyal government at the polls is what Modibo Kawu has in mind when he writes as follows:

?If the electoral process does not implicitly deepen confidence, that it can be used to remove bad government and reward those working in the interest of the people, then? the legitimacy of the entire process will be lost?.

Nigerian electoral parties are, however, not elite factional electoral parties. Nigerian electoral parties are elite formation parties. Elections they engage in are processes of contestation for proprietary control of government, which in turn is established for proprietary control of society and its economy. Given the purpose of government and its endowed capability, opposition politics is precluded.

The ?political opposition? must in the interlude between elections organise for the takeover of government, a process that threatens ?Government?, for the office and the officeholder are treated as one. Monitoring elections of elite factional politics is thus structurally different from monitoring a ?take-over-of-governments? elections. Factional electoral politics admit of third parties? interest in the conduct of parties.

Proprietary electoral parties structures the electorate into ?Us? and the ?Enemies?, into ?Friends and Foes?. A constitutionally prescribed INEC must, therefore, improvise its mediatory relevance. The headline of Vanguard Thursday July 12, 2012, is corroborative. In red letters Vanguard describes the election:

The Vanguard story conveys the frenzy of amoral contestations typical of sectarian ideological wars.

?There was chaos in the House of Representatives, yesterday, as rival party members took strong partisan positions over the deployment of troops ahead of the Edo State gubernatorial election. The uproar ensued as the Chairman of the Independent National Electoral Commission, INEC, Professor Attahiru Jega and the Inspector General of Police, Mohammed Abubakar vowed at a stakeholders party at Benin that this weekend?s election would be used as a test run of the pledge to ensure free and fair elections in the country? Jega and Abubakar on the occasion addressed serious concerns raised by the leading candidates, Adams Oshiomhole of the ACN and Charles Airhiavbere of the Peoples Democratic Party, PDP, over plans to rig the polls.

Among the observations raised by Oshiomhole were that the PDP was mobilizing fake soldiers and policemen and equally distributing fake voter?s cards for the election? At the end of the meeting as the IGP prepared to board a plane back to Abuja, he directed the Commissioner of Police (Operations), Mr. Femi Adenaike to take over as the new Commissioner of Police for Edo State.

All the Area Commanders and Divisional Police Officers, DPOs were also affected. The Police Service Commission, PSC, also yesterday said that it is deploying top officials of the Commission to monitor conduct of policemen during the election.

The Commission has also released telephone numbers through which malfeasances by policemen could be channeled? The Conference of Nigeria Political Parties, CNPP, also warned that any plan to use the security agencies to rig the election would lead to strong reaction from the populace?.

This militaristic security framework of elections is typical and not an exception. It is so because what is at stake is not change of officeholders but something much more- the control; and command of Edo State by an ownership government. Monitoring elections where inclusion and exclusion in elite formation is what is at stake for the next four years is different from monitoring elections where the electorate decide who would be voted for or voted against.

The Edo guber election is not a confidence building event on the effectiveness of elections to remove bad office holders and to reward good officeholders; it is a test of whether governments can be removed by means other than war.

It is evident enough that ?the do or die? electoral politics constitute another security threat to the Nigerian society; but it is not the primary threat.

The primary threat to the Nigerian country formation project is the failure of the Nigerian political elite to realise that the spate of insurgencies in the country is reducing government?s span of ownership control of the Nigerian polity. The Edo guber election may unfortunately not teach this much needed lesson.

(AP) ? The suspect in the Colorado shooting rampage displayed behavior that a gun range owner thought was "bizarre," but it is still unclear if anyone at the university where he studied had any hint of his plans.

Police said James Holmes began buying guns at Denver-area stores nearly two months before Friday's shooting. He also received at least 50 packages in four months at his home and the University of Colorado that authorities are investigating to see whether they contained materials for the potentially deadly booby traps that police found in his apartment.

At the same time, the quiet 24-year-old was in the final weeks of the first year of a rigorous Ph.D. neuroscience program, where he took a three-part final exam required for students to progress in the program and was scheduled to give a presentation on MicroRNA Biomarkers before abruptly leaving in June.

Holmes is being held without bond on suspicion of multiple counts of first-degree murder after a shooting rampage minutes into a premiere of "The Dark Knight Rises" in Aurora early Friday that left 12 people dead and 58 injured.

He is scheduled for an initial hearing Monday and has been assigned a public defender.

Amid the continuing investigation of Holmes and his background, Sunday was a day for healing and remembrance in Aurora, with President Barack Obama arriving to visit with families of the victims and a vigil planned later in the evening.

Congregations across Colorado prayed for the shooting victims and their relatives. Churches sent out social-media appeals for neighbors who wanted to join in remembrance. Elderly churchgoers at an aging Presbyterian church within walking distance near Holmes' apartment joined in prayer, though none had ever met him.

Holmes was being held in solitary confinement at a Denver-area county detention facility and was not cooperating to authorities, Aurora Police Chief Dan Oates said.

"He lawyered up. He's not talking to us," the chief said.

Authorities are working with FBI behavioral analysts and are looking into Holmes' relationships to figure out a motive, which could take months, Oates said.

The gunman's semiautomatic assault rifle jammed during the attack at the Aurora movie theater, forcing him to switch to another gun with less firepower, a federal law enforcement official told The Associated Press. That malfunction and weapons switch during the shooting rampage might have saved some lives.

Oates said a 100-round ammunition drum was found in the theater but said he did not know whether it jammed or emptied.

The owner of a gun range told the AP that Holmes applied to join the club last month but never became a member because of his behavior and a "bizarre" message on his voice mail.

He emailed an application to join the Lead Valley Range in Byers on June 25 in which he said he was not a user of illegal drugs or a convicted felon, said owner Glenn Rotkovich. When Rotkovich called to invite him to a mandatory orientation the following week, he said he heard a message on Holmes' voice mail that was "bizarre ? guttural, freakish at best."

He left two other messages but eventually told his staff to watch out for Holmes at the July 1 orientation and not to accept him into the club, Rotkovich said.

Three days after the massacre, it still remained unclear whether Holmes' professors and other students at his 35-student Ph.D. program noticed anything unusual about his behavior. His reasons for quitting the program in June, just a year into the five- to seven-year program, also remained a mystery.

The university declined to release any details of his academic record, citing privacy concerns, and at least two dozen professors and other staff declined to speak with the AP. Some said they were instructed not to talk publicly about Holmes in a blanket email sent to university employees.

Jacque Montgomery, a spokeswoman for the University of Colorado medical school, said that police have told the school to not talk about Holmes.

The university also took down the website for its graduate neuroscience program on Saturday.

Dan Keeney, president of DPK Public Relations in Dallas, said asking for silence from university employees because of a police investigation was appropriate, but taking down the website was "indefensible" for a publicly funded university unless the school believed it contained inaccurate information relating to the suspect.

"It's an indefensible action," he said. "It's disappointing to hear that they would take that action because it suggests that it's not in the public's interest to have access to that information and I think it is in the public's interest."

The school took down the neuroscience department's site at the request of faculty and staff who had privacy concerns, Montgomery said

The University of Colorado also disclosed it was cooperating with police who were looking into whether Holmes used his position as a graduate student to order materials in the potentially deadly booby traps that police said they found in his apartment.

The apartment was booby trapped with jars of liquids, explosives and chemicals that could have killed "whoever entered it," Oates said, noting it would have likely been one of his officers. Investigators spent hours removing the explosive materials Saturday.

Among the dead was a 6-year-old girl and a man who died on his 27th birthday and a day before his wedding anniversary. Families grieved and waited at hospitals, with police reporting 11 people still in critical condition as of Saturday.

While authorities continued to refuse to discuss a possible motive for one of the deadliest mass shootings in recent U.S. history, details about Holmes' background as a student and would-be scientist trickled out.

He had recently withdrawn from the competitive graduate program in neuroscience at the University of Colorado Denver, where he was one of six pre-thesis Ph.D. students at its Neuroscience Program to be funded by a prestigious grant from the National Institutes of Health. The program of 35 students is dedicated to training outstanding neuroscientists and academicians who will make significant contributions to neurobiology, the university said in a statement.

In the first year of the five- to seven-year program, students take classes and complete three, three-month research rotations in the labs of different professors.

Professors who worked with him either did not return calls or declined to comment, saying police and university officials had told them not to speak to the media.

At one point in the year, Holmes was engaged in research about RNA and was to present a paper May 8 about RNA Biomarkers, according to a class schedule. It was unclear if he presented the paper.

Holmes recently took an intense, three-part oral exam that marks the end of the first year. Those who do well continue with their studies and shift to full-time research, while those who don't do well meet with advisers and discuss their options, including retaking the exam.

University officials would not say if he passed, citing privacy concerns.

The university said Holmes gave no reason for his withdrawal, a decision he made in June.

Holmes was not allowed access from the institution after his withdrawal, which was "standard operating procedure" because he was no longer affiliated with the school, Montgomery said. Holmes had no contact with university police, she said.

A resume posted on Monster.com paints a picture of a brilliant young man brimming with potential: He worked as a summer intern at the Salk Institute for Biological Studies in La Jolla in 2006 and mapped the neurons of Zebra finches and studied the flight muscles of hummingbirds while an undergraduate at the University of California, Riverside.

Ritchie Duong, a friend who has known Holmes for more than a decade, told the Los Angeles Times that in high school he liked to play cards and video games. They both attended undergraduate school at the University of California, Riverside, where they saw each other once a week to watch the TV show "Lost."

Duong last saw Holmes in December when they met for dinner in Los Angeles and saw a movie together. His friend seemed fine, he told the newspaper.

Academics came easily to Holmes both at high school and at the UC Riverside, Duong said.

"I had one college class with him, and he didn't even have to take notes or anything. He would just show up to class, sit there, and around test time he would always get an 'A,'" said Duong, 24.

During the attack early Friday, Holmes set off gas canisters and used the military-style semiautomatic rifle, a shotgun and a pistol to open fire on the unsuspecting theater-goers, Oates said. Holmes had bought the weapons at local gun stores in the past two months. He recently purchased 6,000 rounds of ammunition over the Internet, the chief said.

The gun that jammed had a high-capacity ammunition magazine, according to the federal law enforcement official who spoke to The Associated Press on condition of anonymity in order to discuss the investigation. Police have said that a 100-round drum magazine was recovered at the scene and that such a device would be able to fire 50 to 60 rounds a minute.

The Batman movie, the last in the trilogy starring Christian Bale, opened worldwide Friday with midnight showings in the U.S. "The Dark Knight Rises" earned $30.6 million in the midnight screenings, and, according to industry estimates, roughly $75 million on that day as a whole. That put it on track for a weekend total of around $160 million, which would be the second-highest opening weekend ever, following "The Avengers."

The shooting was the worst in the U.S. since the Nov. 5, 2009, attack at Fort Hood, Texas. An Army psychiatrist was charged with killing 13 soldiers and civilians and wounding more than two dozen others.

Across the street from the movie theater, a man who placed 15 crosses near Columbine High School after a 1999 massacre there has returned to Colorado with 12 crosses for the victims of Friday's shooting.

Greg Zanis, of Aurora, Ill., put up the 3 1/2-foot-tall crosses Sunday on a hill across the street from the Century 16 theater.

2012 NFL Season: Surprise Teams & Disappointment Teams

The 49ers were the major surprise team in the NFL in 2011.

We are coming into the NFL forecasting season where every pro football media person is required, by law, to offer his or her 2012 season prediction for each team. But they always get it wrong! Why? Because they fail to take into account surprise and disappointment teams.

First, some definitions:

I'll define a successful NFL season as one in which a team wins ten games or more. In the ten-year, 32-team era (2002 thru 2011), 37 teams have ended the regular season with a record of 10-6. 32 of them made the playoffs and the five that missed were in the hunt to the last game. Only one team with more than ten wins failed to get into the post season party.

An unsuccessful season is one in which a team loses ten games or more. Any fan that has suffered through a ten-loss season will agree.

A surprise team goes from a ten-or-more loss season to ten-or-more wins in the next season. A disappointment team is just the opposite, going from winning ten or more, to winning six or fewer the next season.

Next, some stats:

Using 1989 as a base year ('88 was a strike year), we get 22 seasons to look at. There has been an average of 2.05 surprise teams and 1.87 disappointment teams per year during that time.

In the 32-team era, with more teams and greater parity, there has been an average of 2.67 surprise teams and 2.56 disappointment teams per year.

Halo 4 Limited Edition Console Leaked Until Microsoft Plumber Could Arrive

An exclusive Halo 4 Limited Edition console was recently leaked in the Microsoft Store but has since been removed. However, the post did stay up long enough for all necessary information to be attained including that the system will retail at the MSRP of $399.99 and will launch alongside Halo 4 on November 6, 2012. The Halo 4 Limited Edition console will come packed with a 320 GB system with two customized controllers, a black Xbox 360 headset, custom sound effects when opening or closing the disc tray or powering the console on or off, and blue LED lights. You'll also get a standard edition copy of Halo 4 and DLC exclusive for the console that includes an in-game armor skin, weapon skin, emblem, matching avatar armor and a unique avatar prop. Halo 4 is now available for preorder from most major retailers for the MSRP of $59.99 and is scheduled to release on November 6, 2012 exclusively for Xbox 360. Halo 4 is not yet rated. Florida Supreme Court upholds state's drug law

TALLAHASSEE ? A Florida law that requires anyone caught with illegal drugs in their possession to prove their innocence has been upheld by the state Supreme Court.

Unlike virtually every other state in the country where it's up to a prosecutor to prove guilt, the 2002 Florida law puts the burden on the person caught with an illegal drug.

For example, if someone wraps a package of cocaine and asks someone else to deliver it to a friend across town and that person gets nabbed, he's automatically in a jam under the Florida law.

The court ruled Thursday that any defendant is presumed to have known what was inside the package was something illegal. Virtually every other state requires prosecutors to convince jurors the defendant knew the contents were illegal.
